We may process your personal data primarily in connection with our mutual contractual relationship — if you are our customer; a business partner who is a natural person (i.e. our supplier, customer, retailer, advisor, representative or other contractual partner); or a contact person, employee, worker, member of a body or other representative of a business partner that is a legal entity. We may also process your personal data, for example, when you visit our website or otherwise communicate with us.

As the controller of personal data, we undertake to process your personal data in accordance with the GDPR and other applicable legislation.
What personal data we process, for what purposes and on what legal basis
Personal data means any information about you that can be linked, directly or indirectly, to your person. Alpha Analytics may process your data for the following purposes and to the following extent. This concerns primarily personal data that you provide to us yourself, or personal data obtained in the course of our relationship with you, or with the person you represent.
Customers
If you are our customer, we process — as the controller of personal data — in particular the data provided in connection with our contractual relationship. This concerns primarily the identification and contact details of customers who are natural persons, and of representatives of our customers who are legal entities (e.g. name and surname or company name, date of birth, address of residence or registered office, IČO/DIČ, email address, telephone), data related to processing your order (e.g. payment details according to the chosen payment method), and any other data provided in the course of our mutual communication or processed in connection with the use of our services.
The legal basis for this processing is primarily the performance of a contract, the fulfilment of our obligations laid down by law — in particular in the area of tax and accounting — and, where applicable, our legitimate interests (for example, in the event of potential court or other disputes, or in the event of a transfer of personal data to a potential third party with which we would negotiate the sale of our company or business establishment, or a similar transaction).
Providing your personal data for these purposes is not a contractual or statutory obligation; however, if you do not provide your data, it will prevent us from concluding or performing a contract with you. Such failure to provide data would likewise prevent us from fulfilling our related legal obligations.
In connection with the provision of our services, we also process our customers’ personal data as a processor, to the extent agreed in the data processing agreements concluded with our customers.
Business partners
If you are our business partner who is a natural person (i.e. our supplier, customer, retailer, advisor, representative or other contractual partner), or a contact person, employee, worker, member of a body or other representative of a business partner that is a legal entity, we process your personal data related to the conclusion and performance of our mutual contractual relationship, or the contractual relationship with the person you represent. This concerns in particular identification and contact details, payment details and data on the mutual contractual relationship, and finally data from our communication with you. We obtain this data directly from you or from the business partner you represent. The legal basis for this processing is primarily the performance of a contract, the fulfilment of our obligations laid down by law, and, where applicable, our legitimate interests (for example, in the event of potential court or other disputes).
Communication with third parties
We process your personal data to ensure communication with you, or with the person you represent. This happens, for example, when you contact us by telephone, send us an email, or write to us in customer chat or on our social media accounts. We may also process your contact details if we are interested in establishing cooperation with you (or the person you represent) as our future business partner, or if you represent an organisation or public authority with which we are dealing on a particular matter. The legal basis for this processing is our legitimate interest in ensuring communication with the relevant person, or the performance of a contract with you or a business partner.
Asserting legal claims and cooperation with public authorities
We may also process your personal data, to the extent necessary, for the purposes of establishing, exercising and enforcing legal claims against you, the person you represent, or a third party, and for the purposes of fulfilling obligations imposed by public authorities in cases laid down by law. The legal basis for this processing is our legitimate interest in asserting our legal claims and fulfilling the obligations that apply to us. Providing your personal data for these purposes does not depend on your will.
Website visitors and the storage of cookies
We may also process the personal data of visitors to our website, which we may obtain from cookies. This data may include information about the user’s device. We will process this data only if you decide to give us your explicit consent when entering our website. Providing this data is voluntary. Further information on the storage of cookies is contained in the Cookie Policy set out below in this document.
How and with whom we may share your personal data
We may disclose your personal data to third parties where required by applicable law or where necessary for the purposes for which we process this personal data.
We provide personal data to authorised processors for the purpose of processing personal data for Alpha Analytics on the basis of our instructions. Our processors are persons and companies that provide us with services or carry out individual business activities for us, in particular our cloud storage providers.
In addition to the processors we engage, personal data may — in accordance with the individual purposes of their processing and subject to the implementation of appropriate safeguards — also be made available to the following further parties: (i) our partners acting as independent controllers, e.g. delivery services, auditors, legal and other consultants, where such transfer is lawful and in accordance with the GDPR; (ii) state administration or local government authorities in cases laid down by law, or where they request the personal data on the basis of a statutory authorisation; and (iii) other entities, where you give your consent or where we are entitled to do so in accordance with the GDPR.
How long we retain personal data
We retain your personal data for varying periods depending on the purpose of the processing. In particular, we are obliged to respect the periods laid down by law for retaining certain documents that also contain your personal data. We therefore retain personal data for the period during which (i) it is necessary for the purposes for which it was collected; (ii) it is necessary for the purposes of fulfilling the obligations under our contractual relationship with you or a business partner; (iii) your consent is valid; (iv) we have a legitimate interest in retaining this data, provided that this does not unreasonably interfere with your interests or fundamental rights and freedoms; or (v) it is required by applicable law.
Your rights in connection with the processing of your personal data
As a data subject, you have the following rights:
- The right of access to the personal data held by the controller, which means that you can ask the controller at any time to confirm whether or not personal data concerning you is being processed and, if so, for what purposes, to what extent, to whom it is disclosed, for how long it will be processed, whether you have the right to rectification, erasure, restriction of processing or to object, where the personal data was obtained from, and whether automated decision-making, including any profiling, takes place. You also have the right to obtain a copy of your personal data; the first copy is provided free of charge, and for any further copies the controller may charge a reasonable fee to cover administrative costs.
- The right to rectification of personal data, which means that you can ask the controller to correct or complete your personal data if it is inaccurate or incomplete.
- The right to erasure of personal data (the "right to be forgotten"), which means that the controller must erase your personal data where one of the following grounds applies: (i) the personal data is no longer necessary for the purposes for which it was collected or otherwise processed; (ii) you withdraw the consent on which the processing was based and there is no other ground for the processing; (iii) you object to the processing and there are no overriding legitimate grounds for it; (iv) the processing is unlawful; or (v) the personal data must be erased to comply with a legal obligation of the controller.
- The right to restriction of processing of personal data, which means that, until disputed questions regarding the processing of your personal data are resolved — specifically where (i) you contest the accuracy of the personal data; (ii) the processing is unlawful but, instead of erasure, you request only the restriction of its use; (iii) the controller no longer needs the personal data for the purposes of the processing but you do; or (iv) you have objected to the processing — the controller may only store the personal data, and any further processing is conditional on your consent, or on the data being needed for the establishment, exercise or defence of legal claims.
- The right to data portability, which means that you have the right to obtain the personal data that you provided to the controller with your consent or for the performance of a contract, in a structured, commonly used and machine-readable format, and, where technically feasible, the right to have the controller transmit this data to another controller.
- The right to object to certain types of processing of personal data (specifically processing carried out in the public interest or on the basis of the controller’s legitimate interest) where grounds against the processing arise in your particular situation, which means that in these cases you may lodge a written or electronic objection to the processing of your personal data with the controller, with the effect that the controller will no longer process the personal data unless it demonstrates compelling legitimate grounds for the processing that override your interests, rights and freedoms, or for the establishment or exercise of legal claims.
- The right to withdraw consent, where we process your personal data on the basis of consent. You may withdraw at any time, without giving any reason, the consent to the processing of personal data that you previously gave us. In such a case we will delete your personal data, unless we need this data for other purposes. This does not apply in cases and to the extent that consent is not the legal basis for the processing.
- The right to lodge a complaint with a supervisory authority. The supervisory authority competent for the protection of personal data in the Czech Republic is the Office for Personal Data Protection (Úřad pro ochranu osobních údajů), with its registered office at Pplk.
